Tract 1

AUCTION ACRES: 454 +/- acres of tillable dryland and 41 +/- acres of native grass and pasture


LEGAL DESCRIPTION: 495+/- acres in the North Half (N/2) and the Southeast Quarter (SE/4) of Section Thirty-two (32), Township Thirty (30), Range Twenty-four (24) West of the 6th P.M., in Clark County, Kansas.


DIRECTIONS FROM MINNEOLA, KS: From the intersection of Hwy 54 and Oak St. (Hwy 283) go approximately 4.0 miles South on Hwy 283 to Road G., then, 2.5 miles East. This will put you on the Southwest corner of the subject property. Signs will be posted.


CROP BASIS:

N/2 of S32, T30, R24W

Wheat: 125.83 base acres; 40 PLC Yield

Grain Sorghum: 101.46 base acres; 61 PLC Yield


SE/4 of S32, T30, R24W

Wheat: 72.23 base acres; 40 PLC Yield

Grain Sorghum: 58.24 base acres; 61 PLC Yield


MINERALS: The entirety of the seller’s mineral interest will sell with the land. All of the minerals are believed to be intact, open, and unleased.


POSSESSION: The buyer will receive possession of the acres planted to milo upon the completion of the 2026 fall harvest. The buyer will receive immediate possession of the remaining open acres upon closing.


INPUT EXPENSES: The buyer will be responsible for a total of $2,862.38 in input expenses related to the preparation of approximately 84.53 acres for planting. The buyer shall also be responsible for $4,643.38 in chemical application expense for weed control on the wheat stubble. Both amounts shall be due and payable at closing.


TAXES: The 2025 real estate taxes totaled $2,037.78. The seller will be responsible for the entirety of the 2026 real estate taxes.


WATER WELL: There is one submersible domestic water well located within the native grass/pasture acres of the subject property. Neither the seller nor Burkhart Real Estate & Auction are making any guarantees regarding the functionality of the domestic water well. The water stock tank will not be sold with the land.


WIND ENERGY LEASE: There are 2 wind turbines located on this tract that are subject to a wind energy lease with Cimarron Bend Wind Project, LLC (Tradewind Energy), currently in its extended term. The lease commenced on May 1, 2016, and is set to expire on December 31, 2056. Per the current owner, the lease generated quarterly income of $5,625.44 in 2024 and 2025, equating to $22,501.76 annually.


Tract 2

AUCTION ACRES: 111+/- acres of tillable dryland and 39+/- acres of CRP


LEGAL DESCRIPTION: 150+/- acres in the Southwest (SW/4) of Section Twenty-five (25), Township Thirty (30), Range Twenty-five (25) West of the 6thP.M., in Clark County, Kansas.


DIRECTIONS FROM MINNEOLA, KS: From the intersection of Hwy 54 and Oak St. (Hwy 283) go approximately 3.0 miles South on Hwy 283 to Road F. This will put you on the Southwest corner of the subject property. Signs will be posted.


CROP BASIS:

Wheat: 48.70 base acres; 40 PLC Yield

Grain Sorghum: 39.27 base acres; 61 PLC Yield


CRP INFORMATION: There is one Conservation Reserve Program (CRP) contract located on this tract. There is a total of 39.28 acres enrolled under Contract #11231. This CRP contract commenced on October 1, 2022, and will expire on September 30, 2032. The rental rate per acre is $20.82 for a total annual CRP payment of $818.00. The buyer will receive the entirety of the 2026 CRP payment.


TRANSMISSION LINE LEASE: This tract is subject to an existing transmission line lease with Cimarron Bend Wind Project, LLC (Tradewind Energy), currently in its extended term. The extended term commenced on April 1, 2020, and is set to expire on December 31, 2060. The annual lease payment for 2026 was $6,659.00. The buyer will be entitled to receive the 2027 annual lease payment, which is scheduled to be paid in January 2027.


MINERALS: The entirety of the seller’s mineral interest will sell with the land. All of the minerals are believed to be intact, open, and unleased.


POSSESSION: All tillable acres are currently planted to milo. The buyer will receive possession of the tillable acres upon the completion of the 2026 fall harvest. The buyer will receive immediate possession of the CRP acres upon closing.


TAXES: The 2025 real estate taxes totaled $361.82. The seller will be responsible for the entirety of the 2026 real estate taxes.


MANNER OF SALE: This real estate will be offered in 2 individual tracts only. No acres will be combined or divided.


SALE METHOD: The real estate will be offered for sale by bid by phone auction. Buyers must register and place an initial bid prior to Thursday, September 10, 2026 – 10:00am CST to be included in the bidding pool. All bids must be submitted to Mike Burkhart by telephone at 620-430-2000. After each bidding pool closes, all active bidders will be informed of the high bid and allowed to advance their bids. The auctioneer will contact each bidder in the bidding pool for advancement of bids starting on Thursday, September 10, 2026 – 10:00am CST. Bids will be accepted until no further advances are made. All bidding parties will remain confidential. Bidding increments will be at the sole discretion of the auction company. Bidders agree that once a bid is submitted the bid will be honored.


TERMS: The successful bidder(s) will pay a $25,000.00/tract earnest money deposit to be paid down the day of sale with the signing of the contract. Buyer and seller will split the cost of title insurance & escrow fees 50/50. Balance of purchase price will be due at closing, on or before October 13, 2026, or upon such terms as may be acceptable to the sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. Earnest money will be held by High Plains Title in Dodge City, KS in their trust account. High Plains Title will also serve as the closing agent and will prepare and complete all title work. Financing, if necessary, must have been arranged and approved prior to the auction.


EVIDENCE OF TITLE: Seller will provide title insurance to the buyer(s) in the amount of the purchase price, with the premium to be paid one-half by the seller and one-half by the buyer(s). Escrow fee will be split 50/50.


FSA INFORMATION: All information is deemed correct. Acreage figures are considered approximate and are from reliable sources. However, it is the buyer’s responsibility to do their own due diligence. Future FSA payments, if any, will follow the crops and new buyer(s).


INSPECTIONS: Each potential buyer is responsible for having conducted their own independent inspection and due diligence concerning pertinent facts about the property prior to signing the contract.
