LEGAL DESCRIPTION: 80 +/- acres in the East Half (E/2) of the Northwest Quarter (NW/4) of Section Sixteen (S16), Township Thirty-three (T33), Range Twenty-seven (R27) in Meade County, Kansas.
AUCTION ACRES: 80 +/- acres of tillable dryland
DIRECTIONS FROM FOWLER, KS: From the intersection of Hwy 54 and H Road, travel 3.7 miles West on Hwy 54 to 23 Road, then approximately 11 miles South on 23 Road to U Road, and 0.5 mile West to the Northeast corner of subject property. Signs will be posted.
DIRECTIONS FROM MEADE, KS: From the intersection of E. Carthage St. and S. Fowler Street, travel 4.7 miles East to 23 Road, then 7 miles South on 23 Road to U Road, and 0.5 mile West to the Northeast corner of the subject property. Signs will be posted.
MINERALS: The entirety of the seller’s mineral interest, if any, will sell with the land. All of the minerals are believed to be intact, open, and unleased. No evidence or proof of title will be provided for the mineral interest selling with the land.
POSSESSION: Upon closing, the buyer will receive immediate possession. All acres are open.
TAXES: The 2023 total taxes were $401.70. The seller will be responsible for paying in its entirety the 2024 real estate taxes.
MANNER OF SALE: This real estate will be offered in 1 individual tract only. No acres will be combined or divided.
TERMS: The successful bidder will pay a $25,000.00 earnest money deposit immediately following the auction. Contract closing will be on or before Wednesday, December 11, 2024, or upon such terms as may be acceptable to the sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. Earnest money will be held by Meade County Title in Meade, KS in their trust account. Meade County Title will also serve as the closing agent and will prepare and complete all title work. Bidding is not contingent upon financing. Financing, if necessary, must have been arranged and approved prior to the auction.
EVIDENCE OF TITLE: Seller will provide title insurance to the buyer in the amount of the purchase price, with the premium to be paid one-half by the sellers and one-half by the buyers. Escrow fee will be split 50/50. No evidence or proof of title will be provided for the mineral interests selling with the land.
FSA INFORMATION: All FSA information is deemed correct and was obtained from reliable sources. Any future FSA payments will follow the crops and new buyer.
INSPECTIONS: Each potential new buyer is responsible for having conducted their own independent inspection and due diligence concerning pertinent facts about the property prior to the signing of the contract. Neither the seller nor Burkhart Real Estate & Auction, its agents, or representatives, are making any warranties about the property, either expressed or implied.
