TRACT 1 – FORD COUNTY, KS

AUCTION ACRES: 480 +/- acres of tillable dryland with four operating wind turbines.


LEGAL DESCRIPTION: 480 +/- acres in the North Half (N/2)  and the Southwest Quarter (SW/4) of Section Twenty-eight (28), Township Twenty-nine (29), Range Twenty-four (24) West of the 6th P.M., Ford County, Kansas.


DIRECTIONS FROM MINNEOLA, KS: From the intersection of Hwy 283 (Oak St.) and Hwy 54, travel north 3 miles to Yucca Rd., then east 3 miles to Booster Station Rd. This will put you on the southwest corner of the subject property. Signs will be posted.


DIRECTIONS FROM BLOOM, KS: From the intersection of Main St. and W. Bloom Rd., travel west 2.5 miles on W. Bloom Rd. to 115 Rd., then north 0.50 mile. This will put you on the southeast corner of the subject property. Signs will be posted.


DIRECTIONS FROM DODGE CITY, KS: From the intersection of Hwy 400 and Hwy 283, travel south approximately 16 miles on Hwy 283 to Yucca Rd., then east 3 miles to Booster Station Rd. This will put you on the southwest corner of the subject property. Signs will be posted.


WIND ENERGY LEASE:

This tract is being sold subject to an existing wind energy lease with Capital Power as the tenant. The lease commenced on 11/4/2011 and expires on 11/4/2036. Under the terms of the current lease agreement, the operator (Capital Power) has the right to extend the agreement for one term of ten years, which would extend the agreement to 2046. There are four wind turbines located on this tract that are in the operations term period of the wind energy lease. Over the past four years, collectively the wind turbines have generated an annual lease payment of $35,640.00. Additionally, the wind turbines have generated a royalty payment of $13,064.77 in 2022, $13,199.44 in 2023, $6,846.96 in 2024, and $11,386.63 in 2025. The annual royalty payment is calculated based on a percentage of the gross sales produced by the turbines. This percentage increases 0.50% every five years. The new buyer will receive the full annual lease payment and royalty payments beginning in January 2026. A copy of the wind energy lease will be provided to the buyer after closing. It will be the buyer’s responsibility to contact the wind energy company to notify them of the ownership change.


CROP BASIS:

Wheat: Base Acres - 301.00; PLC Yield - 41

Grain Sorghum: Base Acres - 44.20; PLC Yield - 84


MINERALS: The entirety of the seller’s mineral interest will sell with the land. All of the minerals are believed to be intact, open and unleased.


TAXES: The 2024 real estate taxes totaled $4,919.94. The seller will be responsible for paying the entirety of the 2025 real estate taxes. The buyer will be responsible for paying the entirety of the 2026 real estate taxes and all subsequent years. 


POSSESSION: The entirety of the subject property is planted to wheat that will be harvested in in the summer of 2026. The buyer will receive possession of the subject property as soon as the wheat crop is harvested or August 1, 2026, whichever is sooner. The buyer shall acquire the seller’s one-third (1/3) interest in the referenced wheat crop and shall assume responsibility for one-third (1/3) of all expenses incurred in connection with said crop through maturity.


MANNER OF SALE: This real estate will be offered in 1 individual tract only. No acres will be divided. There will be no combination of any tracts.


TERMS: The successful bidder(s) will pay a $25,000.00 earnest money deposit per tract to be paid down the day of sale with the signing of the contract. Buyer and seller will split the cost of title insurance & escrow fees 50/50. Balance of purchase price will be due at closing, on or before January 12, 2026, or upon such terms as may be acceptable to the sellers. If the buyer prefers to close before the end of the 2025 calendar year, that request can be accommodated. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. Earnest money will be held by High Plains Title, Dodge City in their trust account. High Plains Title will also serve as the closing agent and will prepare and complete all title work. Financing, if necessary, must have been arranged and approved prior to the auction.


EVIDENCE OF TITLE: Seller will provide title insurance to the buyers in the amount of the purchase price, with the premium to be paid one-half by the sellers and one-half by the buyers. Escrow fee will be split 50/50. Click here to review the preliminary title commitment.
