WIND ENERGY LEASE: This land is being sold subject to a wind energy lease that is in the Development Term dated 7/1/2022 with a development term length of 7 years. The buyer will receive a copy of the lease after the closing date. During the developmental term, the annual payment is $2.00/acre (increasing $0.50 per year until it reaches $4.50 per acre). The buyer will begin receiving the wind energy lease payment in 2026.


IRRIGATION INFORMATION: There is one irrigation well located on this tract that is covered under water right file #19718 which is permitted for 320 AF, 160 authorized irrigated acres, and an authorized rate of 1,100 GPM. The current water well has not been pumped or used for several years. Burkhart Real Estate and Auction nor the Seller make any warranties or guarantees regarding the condition or functionality of the water well. The existing water right is in good standing and intact with the Southwest Kansas Ground Water Management District #3. The last time this ground was watered it was flooded, and buyer understands this ground has NEVER been pivot irrigated.

IRRIGATION EQUIPMENT: The following irrigation equipment will be sold with the land. A Weichai NG irrigation engine that was manufactured on March 20, 2017, gear head, driveline, pump, water meter, and all existing underground lines.


FUEL SOURCE: A natural gas tap is located at the existing irrigation well site. The buyer will be responsible for identifying the local gas company, obtaining any necessary information, transferring the service into their name, and arranging for connection of natural gas service.


MINERAL RIGHTS: The entirety of the seller’s mineral interest will sell with the land. All the minerals are believed to be intact, open, and unleased.


TAXES: The 2025 real estate taxes totaled $725.26. The buyer will be responsible for paying the entirety of the 2026 real estate taxes and all subsequent years.


POSSESSION: The buyer will receive immediate possession of the south half of the subject property upon closing. The north half of the subject property is planted to wheat that will be harvested in the summer of 2026. The buyer will receive possession of the north half of the subject property as soon as the wheat crop is harvested. The buyer will receive the seller’s one-third share of the existing wheat crop and shall assume responsibility for one-third of all expenses incurred in connection with said crop through maturity. TRACT 4 WATER RIGHTS: All water rights will be conveyed with the land. There are three irrigation wells located on Tract 4, each covered under separate water right files. Water right file #22862 (located on Legal Description #1), is permitted for 360 AF, 600 authorized irrigated acres, and an authorized pumping rate of 960 GPM. Water right file #11490 (located on Legal Description #2), is permitted for 400 AF, 600 authorized irrigated acres, and an authorized pumping rate of 1,060 GPM. Water right file #18307 (located on Legal Description #3), is permitted for 440 AF, 600 authorized irrigated acres, and an authorized pumping rate of 1,120 GPM.


Collectively, these water rights authorize irrigation of a total of 600 acres, as the place of use overlaps, and provide a combined annual allocation of 1,200 AF of water. All three water right files overlap the same acres in their designated place of use and also include 120 acres in S17, T29, R31 (80 acres located on Legal Description #4 & 40 acres in the NW/4 of the SE/4, which is not owned by the seller).


Due to the overlapping place of use, if a buyer elects to drill a new well anywhere on Tract 4 outside of a 300-foot radius of the existing wells, authorization from the other landowner in S17, T29, R31 will be required. Any new irrigation infrastructure can be installed without regulation, and no permission from other owners is required.

Each water right file is limited to it’s individual permitted annual acre-feet and may not exceed that amount or share pumping authority with other water rights.

IRRIGATED ACRES: 120 +/- Acres of Irrigated Cropland


IRRIGATION INFORMATION: There is one irrigation well located on the SW/4 of S8, T29, R31 that is covered under water right file #11490 which is permitted for 400 AF, 600 authorized irrigated acres, and an authorized rate of 1,060 GPM. Per the flow meter, the irrigation well was pumping 500+/- gallons per minute on December 16, 2025. The irrigation sprinkler located on this land is an 8-tower 2016 Zimmatic LD9332 with 11.2-38 size tires and drop down nozzles that are nozzeled at 600 gallons per minute.


IRRIGATION EQUIPMENT: The following irrigation equipment will be sold with the land. The 2016 Zimmatic LD9332 irrigation sprinkler, gear head, pump, water meter, all underground lines, Cummins NG irrigation engine, and the diesel fuel tank.


FUEL SOURCE: A natural gas tap and meter are on the Farmers Gas distribution system and will be conveyed with the land. Natural gas is supplied by Farmers Gas. WIND ENERGY LEASE: This land is being sold subject to a wind energy lease that is in the Development Term dated 7/1/2022 with a development term length of 7 years. The buyer will receive a copy of the lease after the closing date. During the developmental term, the annual payment is $2.00/acre (increasing $0.50 per year until it reaches $4.50 per acre). The buyer will begin receiving the wind energy lease payment in 2026.


MINERAL RIGHTS: The entirety of the seller’s mineral interest will sell with the land. Sublette Feeders, LLC is the operator of the Spanier "B" 1 gas well located on this tract of land. Per the Kansas Geological Survey website, this well has not produced since 2023 and has not been plugged.


TAXES: The 2025 real estate taxes totaled $431.99. The buyer will be responsible for paying the entirety of the 2026 real estate taxes and all subsequent years.


POSSESSION: All acres are open. The buyer will receive immediate possession on all acres upon closing. The tenant has been notified of their release of tenancy.


MANNER OF SALE: This real estate will be offered in 4 individual tracts only. No acres will be divided. There will be no combination of any tracts.


TERMS: The successful bidder(s) will pay a $25,000.00 earnest money deposit per tract to be paid down the day of the sale with the signing of the contract. Buyer and seller will split the cost of title insurance & escrow fees 50/50. Balance of the purchase price will be due at closing, on or before March 12, 2026, or upon such terms as may be acceptable to the seller. Personal and corporate checks are acceptable for the down payment the final payment to be made in certified funds. Earnest money will be held by First American Title in Garden City, KS in their trust account. First American Title will also serve as the closing agent and will prepare and complete all title work. Financing, if necessary, must have been arranged and approved prior to the auction.


EVIDENCE OF TITLE: Seller will provide title insurance to the buyers in the amount of the purchase price, with the premium to be paid one-half by the seller and one-half by the buyer(s). Escrow fee will be split 50/50.
